From 1st August important changes to property transactions were introduced in Queensland under the new property Law Act 2023 (The Act).
Sellers scramble ahead of sweeping new property laws.
New Queensland property law sparks market jitters and creates niche disclosure service industry. This might well move through each state in Australia in 2026 The legal paradigm for property transactions has shifted in Queensland: the onus for discovering and revealing property issues has been decisively transferred from the purchaser to the vendor. Under the seller disclosure scheme, Queensland sellers must provide detailed reports about a property before any contract is signed. The new act introduces a mandatory seller disclosure scheme.
Here’s a brief overview of what you need to know and do under the scheme if you’re planning to sell a property.
- Residential property houses, townhouses, units
- Commercial properties
- Vacant land
- The scheme requires that sellers give buyers key information about a property before a contract of sale is signed.
- The buyer may be able to terminate the contract if the seller does not comply with the new changes.
- You should seek independent legal advice about the specific obligations that apply to you when selling a property.
This new change when selling a property will go national next year, 2026. For more information about property pest inspections please call:
